The U.S. Forest Service recently issued final regulations that authorize it to sell small tracts of federal land valued up to $500,000 pursuant to amendments to the Small Tracts Act. The Small Tracts Act authorizes the USFS to sell certain small parcels such as lands that have been encroached on by a privately owned structure or road and which the agency believes are better off under private ownership. The law was amended not only to increase the value of these parcels, but to allow the sale of cemeteries, landfills or sewage treatment plants on USFS lands that are currently authorized under special use authorizations. Typically, these lands are sold to local jurisdictions. The funds received by the agency can then be used to acquire land for the National Forest System including land for recreational access.
