Preserved the award of a major federal concession contract

A disappointed competitor waged a protest against our client's National Park Service contract award. Garden Law assisted and worked closely with the National Park Service to defend the contract award. We secured the $150,000,000 concession contract for our client.

Obtained key ruling for U.S. Forest Service Special Use Permits

We represented our client in the first court case establishing recreational Forest Service Term Special Use Permits as enforceable contracts. The ruling found permits create binding obligations on the US Forest Service, not just the permit holder. As a result, the agency compensated our client $1,000,000 for having violated its legal obligations.

Grand Teton National Park

Turned initial denial into multi-year concession contract

We demonstrated the illegality of a National Park Service award decision in court, which NPS then ignored. We persevered by filing a second lawsuit using a novel legal theory in another court district which recognized NPS's disregard of the prior judicial ruling. This ruling resulted in NPS voluntarily agreeing to award a multi-year concession contract to our client. NPS now agrees that our client is one of its best concessioners and has awarded it additional concession contracts.

Prevailed in establishing Leasehold Surrender Interest valuation of $600,000

The National Park Service determined that our client’s infrastructure was not part of its Leasehold Surrender Interest. Garden Law challenged and won a new determination for our client. This resulted in an additional property value of approximately $600,000. 

Challenged improper tax assessments

Kevin brought a successful challenge to taxes improperly imposed by a local municipality on our client’s operations on federal lands.

Persuaded the Forest Service to withdraw its improper revocation of an outfitter's permit

When the U.S. Forest Service revoked our client’s outfitter’s permit, we appealed the decision using the agency's appeal process. We then persuaded the superior agency official to reverse the agency decision allowing our client to continue serving clients on National Forest System land. 

Blocked National Park Service from closing concessioner operations

The National Park Service issued decisions to close multiple clients' existing concessions operations on the East and West Coasts. Garden Law mounted successful challenges to the Park Service decisions. We preserved the Park Service’s financial liability to concessioners, and those concessions were allowed to continue their operations on Park Service lands.

Prevented closure of campground concessions

Kevin brought a lawsuit against the USDA Forest Service challenging the closure of Forest Service campground concessions during the 2013 government budget impasse. Our client's campground operations were immediately re-opened.


Forced National Park Service to pay fair concession value

Our client faced a dramatic lowering of value on their concession structures on National Park Service land. Kevin brought a successful lawsuit challenging the Park Service’s method of valuation. We reached a settlement several times beyond what the Park Service wanted to pay.

Held USDA Forest Service accountable for getting public input

When implementing a new trail classification system, the USDA Forest Service failed to obtain public comments. Garden Law advocated before the federal district court in Washington, D.C, on behalf of our client. We obtained a seminal decision that changed the agency's prior policy and required public input for any directives that constituted standards, criteria or guideline applicable to Forest Service programs. As a direct result of our successful lawsuit, the Forest Service was bound to obtain proper public input on the new trail system, allowing increased public recreational opportunities on Forest land.  The Forest Service has now codified this new policy at FSH 1109.12.

Prevailed in Federal Claims Court and GAO bid protests

Kevin has served as counsel in numerous Court of Federal Claims and Government Accountability Office bid protests involving a wide range of government procurements, from computer services to concession contracts. He has assisted his clients in obtaining government contracts with revenues in excess of $600,000,000.

Settled over $12 million in Boards of Appeals contract claims

Kevin successfully settled over $12,000,000 in contract claims before numerous Boards of Contract Appeals, including:

  • Interior Board of Contract Appeals
  • Department of Agriculture Board of Contract Appeals
  • Corps of Engineers Board of Contract Appeals
  • Armed Services Board of Contract Appeals
  • General Services Board of Contract Appeals

  • Drafted federal legislation which was included in the EXPLORE Act enacted in 2025.
  • Testified before Congress in relation to National Park Service concession contract issues.
  • Briefed federal Representatives and Senators on issues related to federal government contract matters.
  • Litigated in numerous federal district courts on government claims and federal land management issues.
  • Brought a successful lawsuit challenging the denial of a Freedom of Information Act request.
